Keyboard Cat and Nyan Cat creators file lawsuit over Scribblenauts developers

The creator of Nyan Cat, Christopher Torres, and Keyboard Cat’s owner, Charles Schmidt, have filed a copyright and trademark infringement lawsuit against Warner Bros. And 5th Cell over their creation appearances in the Scribblenauts in 2009, the 2010 Super Scribblenauts, 2011 Super Scribblenauts Remix and 2012 Scribblenauts Unlimited

The complaint was filed on April 22nd and alleges that developer 5th Cell did not seek permission to include either of the copyrighted characters in their published products or in related promotional material. “Plaintiffs claim that Warner Bros and 5th Cell’s trademark infringement was willful and intentional and are requesting an award of treble damages and requesting the case be deemed exception under 15 U.S.C. § 1117(a), thereby entitling Plaintiffs to an award of reasonable attorneys’ fees”.

The Scribblenauts series has been known to allow players to summon a large number of creatures and memes during gameplay for puzzles or comedic effect.
